These Customer Terms and Conditions (“Customer Terms”) govern access to and use of the website, mobile application, services and technology platform operated under the brand name “KaamSet Hai” by [LEGAL COMPANY NAME], having its registered office at [REGISTERED ADDRESS], CIN [CIN] (“KaamSet”, “Platform”, “Company”, “we”, “our” or “us”).
By registering, requesting a service, paying a booking fee, approving a quotation, confirming a work milestone or otherwise using the Platform, the customer (“Customer”, “you” or “your”) agrees to these Customer Terms, the Privacy Policy, applicable service-category rules and the specific digital Work Order.
1. Eligibility and Account
1.1 You must be at least eighteen years old and legally competent to enter into a contract.
1.2 You shall provide accurate name, mobile number, service address and other requested information.
1.3 You are responsible for all activity carried out through your account and for protecting OTPs and login credentials.
1.4 You shall immediately report suspected unauthorised use of your account.
2. Nature of the Platform
KaamSet is a technology-enabled marketplace and facilitation platform that may assist with:
- Discovery of independent service providers.
- Identity and document verification.
- Appointment and visit coordination.
- Recording the agreed work scope and quotation.
- Work-milestone tracking.
- OTP-based milestone confirmation.
- Storage of photographs, videos and digital records.
- Complaint coordination.
- Assignment of a replacement service provider where reasonably available.
KaamSet does not itself perform electrical, plumbing, carpentry, painting, construction, interior, appliance-repair, event or other listed work unless a particular Work Order expressly identifies KaamSet as the direct service provider.
The service provider assigned or selected for a booking (“Service Provider”) is an independent professional or contractor and is not an employee, agent, partner, franchisee or representative of KaamSet.
The contract for execution of the physical work is directly between the Customer and the Service Provider under the approved Work Order.
KaamSet does not guarantee the availability, uninterrupted attendance, financial capacity or future conduct of any Service Provider.
3. Booking Fee
KaamSet may charge a separate platform booking or facilitation fee of ₹[AMOUNT], plus or inclusive of applicable taxes as displayed before payment.
The booking fee is consideration only for platform access, verification, coordination and related digital facilities. It is not part of the Service Provider’s labour or material charges.
The booking fee does not create any obligation on KaamSet to pay the Service Provider, finance the work, compensate property damage or guarantee completion.
The applicable refund or cancellation status shall be displayed before confirmation. Where KaamSet cancels a confirmed booking and does not provide a reasonable replacement, the booking fee shall be refunded to the extent required by applicable law and the displayed cancellation policy.
4. Direct Payment Between Customer and Service Provider
All labour, material, travel, helper and project payments shall be independently agreed and exchanged directly between the Customer and Service Provider.
KaamSet shall not:
- Collect or hold the Service Provider’s payment.
- Provide a Service Provider’s QR code or UPI ID.
- Operate an escrow or wallet for labour payments.
- Transfer, release or settle labour payments.
- Guarantee payment to the Service Provider.
- Guarantee refund to the Customer.
- Maintain an authoritative record of how much money was paid.
The Customer and Service Provider are independently responsible for selecting the payment mode, obtaining receipts and maintaining tax, banking and transaction records.
Any private payment, advance or financial arrangement is at the respective parties’ risk. KaamSet is not liable for cash disputes, chargebacks, incorrect transfers, fake payment screenshots, refusal to pay, advance-payment loss or inability to recover money.
A work-milestone confirmation on the Platform confirms only the accepted physical progress described in the Work Order. It does not confirm that any particular payment has been made.
5. Quotation and Work Order
Before work begins, the Customer and Service Provider should approve a digital Work Order recording:
- Work description and location.
- Inclusions and exclusions.
- Labour quotation.
- Responsibility for materials.
- Estimated completion period.
- Milestone structure.
- Category-specific safety requirements.
- Workmanship or defect-correction period, if any.
- Any special conditions.
Quotations are issued by the Service Provider and not by KaamSet.
KaamSet may provide templates, price references or estimate ranges, but they are indicative and are not a binding price guarantee.
Additional work, hidden site conditions, changed measurements, defective existing installations, material price changes or Customer-requested modifications may require a revised quotation.
No revised work should commence until the revised scope is digitally recorded or otherwise clearly accepted by both parties.
6. Milestone and Work-Status System
The parties may choose a work plan such as:
- 25% + 25% + 25% + 25%.
- 25% + 25% + 50%.
- Another displayed milestone structure.
- A custom structure approved in the Work Order.
A percentage represents the agreed physical work milestone and not the percentage of money paid.
The Service Provider may submit a milestone-completion request with photographs, videos and checklist evidence.
The Customer may select:
- Accepted — The visible milestone appears completed according to the agreed scope.
- Accepted with Defects — Substantial progress exists, but specified defects remain.
- Rejected — The milestone does not reasonably match the agreed scope or visible quality.
OTP confirmation shall create a timestamped electronic record of the Customer’s declaration.
The Customer must inspect visible work carefully before submitting an OTP. The Customer shall not knowingly confirm false progress or use OTP confirmation to obtain additional work without fulfilling direct contractual obligations to the Service Provider.
Milestone confirmation does not waive claims relating to concealed defects, electrical hazards, latent leakage, structural danger, fraud, substituted materials or defects that could not reasonably have been discovered during ordinary inspection.
7. Customer Responsibilities
The Customer shall:
- Provide correct site information and disclose known risks.
- Provide lawful and safe access to the premises.
- Disclose concealed wiring, gas lines, water lines, weak structures, hazardous materials, pets, security systems and other relevant conditions.
- Obtain landlord, society, municipal or other permissions where required.
- Keep children, elderly persons, pets and unauthorised persons away from hazardous work areas.
- Not instruct a Service Provider to violate safety standards, building rules or law.
- Not energise, operate or tamper with incomplete electrical, gas, structural or mechanical work.
- Inspect materials supplied by the Customer and ensure they are suitable for the intended purpose.
- Provide reasonable facilities necessary for the work.
- Cooperate with incident investigation and evidence preservation.
8. Customer-Supplied Materials
Where the Customer purchases or supplies material, the Customer is responsible for authenticity, specifications, quantity, compatibility and manufacturer warranty.
The Service Provider must notify the Customer where material appears visibly unsafe or unsuitable.
The Service Provider may refuse to install material that appears illegal, defective, under-rated or unsafe.
KaamSet is not responsible for losses caused by counterfeit, defective, incompatible or incorrectly selected Customer-supplied material.
9. Service Provider-Supplied Materials
Where the Service Provider supplies material, the Service Provider is responsible for disclosing description, quantity, price and available warranty.
The Customer should obtain invoices and warranty documents directly from the Service Provider or seller.
KaamSet does not manufacture, own or warrant materials supplied by independent Service Providers.
10. Replacement Service Provider
KaamSet may attempt to assign a replacement where the original Service Provider abandons, refuses or is unable to continue the work.
Replacement is subject to availability, location, skill requirements and the new Service Provider’s independent acceptance.
The new Service Provider shall inspect:
- Usable completed work.
- Defective work.
- Dismantling or rework required.
- Remaining work.
- Available materials.
- Safety risks.
The new Service Provider may issue an independent quotation.
Money previously paid to the original Service Provider does not bind the replacement Service Provider and does not entitle the Customer to free completion by KaamSet or the replacement Service Provider.
KaamSet shall not bear any difference between the old quotation and the replacement quotation.
11. Defective Work and Warranty Claims
Any workmanship warranty belongs to and is provided by the Service Provider, unless expressly stated otherwise in a separate written KaamSet protection plan.
The Customer must report an alleged defect promptly with photographs, videos, Work Order details and a description of the problem.
The Service Provider shall be given a reasonable opportunity to inspect and, where responsible, rectify the defect.
Warranty or defect responsibility may be denied where loss resulted from:
- Customer misuse or overloading.
- Third-party alteration.
- Customer-supplied defective material.
- Voltage fluctuation or utility failure not caused by the Service Provider.
- Water ingress or structural failure outside the Service Provider’s scope.
- Normal wear and tear.
- Force majeure.
- Failure to follow written safety instructions.
Hidden defects, negligence and safety failures are not automatically waived by milestone acceptance.
12. Accident, Fire, Injury, Death and Property Damage
In any emergency involving electric shock, fire, gas leakage, flooding, structural instability or bodily injury, the Customer must first contact the appropriate emergency service, electricity provider, police, fire department, medical service or competent authority.
The Customer shall not disturb critical evidence except where reasonably necessary to protect life or prevent further damage.
Liability shall be determined according to evidence, applicable law, scope of work, inspection findings and causation.
Where loss is caused by negligent or defective work of a Service Provider, primary responsibility remains with that Service Provider, subject to applicable law and insurance.
Where loss is caused by Customer tampering, misuse, illegal instructions, undisclosed hazards, overloading or Customer-supplied defective materials, the Customer may be responsible.
Where multiple causes contributed to an incident, responsibility may be allocated among the responsible persons.
KaamSet does not assume responsibility merely because it introduced, verified, listed or assigned the Service Provider.
13. Insurance
Some Service Providers may display an insurance status or policy limit.
Insurance is subject to policy terms, exclusions, deductibles, limits, validity, claim investigation and insurer approval.
An “insured” badge is not a guarantee that every incident will be covered or that the insurer will approve a claim.
The insurer, and not KaamSet, determines coverage and settlement.
KaamSet may facilitate claim intimation and evidence sharing but is not an insurer, guarantor or claim-paying entity.
Expiry, cancellation or rejection of an insurance claim does not transfer the Service Provider’s liability to KaamSet.
14. Complaints and Dispute Assistance
KaamSet may review digital Work Orders, milestone records, OTP logs, messages, photographs, videos and party statements.
KaamSet’s support assessment is an administrative platform decision and not a court judgment, technical certificate or legally binding adjudication.
KaamSet may:
- Request further evidence.
- Pause a profile or booking.
- Recommend inspection.
- Assist communication.
- Revise platform work status where evidence justifies it.
- Assign a replacement where available.
- Suspend or remove a Service Provider.
KaamSet cannot compel either party to make a private payment, refund private payments or satisfy a compensation claim.
Independent inspection charges may be allocated to the party found responsible, subject to agreement or lawful determination.
15. No Platform Warranty
To the maximum extent permitted by law, KaamSet does not warrant:
- Uninterrupted availability of any Service Provider.
- Completion within an estimated time.
- That a Service Provider will never default or commit misconduct.
- That verification will identify every past or future risk.
- The quality, durability or safety of physical work.
- Recovery of money paid directly between the parties.
- Approval of any insurance claim.
- That the Platform will be error-free or continuously available.
16. Limitation of KaamSet Liability
To the maximum extent permitted by applicable law, KaamSet shall not be liable for any indirect, incidental, special, punitive, exemplary or consequential loss, including loss of income, business, opportunity, data, goodwill or use.
KaamSet shall not be liable for the acts or omissions of independent Service Providers, helpers, material suppliers, manufacturers, customers, property owners, utilities or other third parties.
KaamSet shall not be liable for:
- Defective workmanship by a Service Provider.
- Abandonment or delay by a Service Provider.
- Non-payment or payment disputes.
- Material defects.
- Theft, misconduct or unauthorised acts of a Service Provider.
- Injury, death, fire, leakage or property damage caused by a Service Provider or site condition.
- Loss arising from Customer instructions or conduct.
- An insurer’s denial or delay.
Subject to Clause 16.5, KaamSet’s aggregate liability arising from a particular booking shall not exceed the booking fee actually retained by KaamSet for that booking.
Nothing in these Customer Terms excludes or limits liability that cannot lawfully be excluded, including liability arising from KaamSet’s own fraud, wilful misconduct, proven direct negligence or mandatory statutory obligations.
No employee, support agent or Service Provider has authority to offer an unlimited compensation promise on behalf of KaamSet.
17. Customer Indemnity
The Customer shall indemnify and hold harmless KaamSet, its directors, officers, employees and affiliates from claims, penalties, losses and reasonable legal costs arising from:
- False information supplied by the Customer.
- Unsafe or undisclosed site conditions.
- Illegal instructions or unauthorised construction.
- Customer tampering, misuse or overloading.
- Injury to a Service Provider caused by Customer-controlled hazards.
- Customer-supplied defective materials.
- Infringement of a landlord’s, neighbour’s, society’s or third party’s rights.
- Breach of these Customer Terms.
This does not apply to the extent directly caused by KaamSet’s own non-excludable wrongdoing.
18. Prohibited Conduct
The Customer shall not:
- Abuse, threaten, discriminate against or harass any Service Provider or support employee.
- Provide false OTP confirmation or fabricated evidence.
- Request illegal or unsafe work.
- Misuse Service Provider identity documents or personal data.
- Manipulate reviews or ratings.
- Create fake bookings.
- Interfere with Platform security.
- Misuse KaamSet’s name to make an unauthorised compensation or warranty claim.
19. Suspension and Termination
KaamSet may restrict or terminate an account for fraud, threats, repeated false complaints, unsafe conduct, illegal activity, non-cooperation, platform abuse or breach of these Customer Terms.
Termination does not affect rights and obligations arising from an existing Work Order.
20. Electronic Records and Data
The Customer consents to the creation and storage of electronic records including OTP logs, Work Orders, photographs, videos, messages, location data where enabled and complaint records.
These records may be used for service administration, safety, fraud prevention, dispute assistance, insurance claims and legal compliance.
Personal data shall be handled in accordance with KaamSet’s Privacy Policy and applicable data-protection law.
Customers shall not upload unnecessary identity documents, private images or third-party personal data.

KaamSet shall endeavour to acknowledge consumer complaints within forty-eight hours and address them within the time required under applicable law.
22. Governing Law and Legal Rights
These Customer Terms are governed by the laws of India.
The parties shall first attempt good-faith resolution through KaamSet’s grievance process.
Nothing in these Customer Terms restricts a Customer from approaching a competent consumer commission, court, regulator, police authority or other statutory authority where legally entitled.
Subject to mandatory consumer jurisdiction, courts at [ALIGARH, UTTAR PRADESH] shall have jurisdiction.
23. Force Majeure
KaamSet shall not be liable for delay or failure caused by events beyond reasonable control, including natural disasters, riots, epidemics, government restrictions, internet or telecom failure, utility disruption or widespread system failure.
24. Changes to Terms
KaamSet may update these Customer Terms for legal, safety, operational or business reasons. Material changes shall be communicated through the Platform. Changes shall not retrospectively remove accrued statutory rights.
25. Severability and Entire Agreement
If any provision is held unenforceable, it shall be limited or removed to the minimum extent necessary, and the remaining provisions shall continue.
These Customer Terms, the Privacy Policy, category rules and the applicable Work Order form the agreement governing use of the Platform.
